Drunken Driving death - Why it is not a murder case?

Another case of drunken wreckless driving and 4 precious lives lost.

KLIK TO READ THE NEWS

The family came to Chennai for their son's heart treatment and after the boy was completely cured, with all the efforts and pains gone into the endeavor, one crazy drunken idiot rams his car into their car and instantly the life is gone.

Look at the car's condition...!! and imagine the effect and force of the impact. The other car was Innova...

And the driver will only get maximum of 10 years imprisonment... that too, if the case was proved with evidence etc.. and the man is not remotely related to any police or politican or businessman of the city and the car didnt belong to any influencial travel operators of the city....!!!

What kind of sense does this make.. if at all there is any?

Why this is not a murder case?

In Chennai, of course, police themselves go to Putucheri for buying cheaper liquor and consume before returning back into Tamil Nadu. Even this differential taxation for union Territories dont make any sense, as these places are within the same country and it only encourages such unwarranted activites.

Unless drunken driving is taken as a serious offence, any death caused is treated as a murder case and strict policing is done for this offence, (I am dreaming...) nobody is safe on the roads of India..

The Goverment and Police's attitude seems to be "so what one in a billion die? We have enough in this country...!!!!", with no value to individual's life...

i know its so sad that no one cares for a human life here.where laws n rules are x implemented, corruption is all time high, caring for each other does x exist.we dont hv an easy answer, but yes,we can take their license away, make it hard for them to drive.we hv got billion ppl,why not employ every one to do some job or the other, where every department has got a body which will b watching that these laws r implemented.like china made these ppl to build china wall,we cud employ all these poor ppl to safeguard our country from these terrorists entering.apni seemaon ko safe banane ke liye kuch to karna hoga.isi tarah har department, har position ko watch karne ke liye ek aur dept banana hoga.jab tak neeyam lagu nahi honge, laws banane ka koi faayda nahi.its not an easy job but something has to b done sooner or later.

this is surely very saddening and causes disillusionement after reading such news but yes, as anand pointed out, we are becoming so attuned to such happening that rarely take notice of same..

ideally speaking everyone is equal in eyes of law and this kind of offence deserves punisment no less than a cold blooded murder...but as u urself pointed out, such ppl with power and money usually escape easily....

there had many many instances of celebrities like salman khan and vivek being involved in such killings but i never heard of their being convicted apart from few case hearings...

right KBsir...currently such cases fall u/S. 304A IPC..if i'm not mistaken which is causing death by gross negligence or recklessness and the max penalty handed out in such offences is upto one yr RI which is clearly not sufficient. wht the law commission can do in this matter is insert a sub section which would only deal with death caused by negligent driving...normally this section is applied widely when docs are involved in cases of medical negligence which becomes a different kind of offence altogether. Docs always perform their duty in good faith however rash driving is a blatant disregard of public safety which should in my opinion be dealt with very strictly.

Absloutely true ...

A drunken driver is a potential murderer.

Alcohol and driving don't mix.

Drunken driving seems to be a problem the world over but nowhere else do the culprits get away with it so easily as in India. The apathy of Indians to such incidents is condemnable.

Raj,

I hate closing on a negative note... for all my determination to look on the bright side... even i am stumped today.

As Solar says... hang the man. To drive is heineous enough a crime to warrant it. For each time a drunk chooses to sit behind the wheel.. a tragedy like this is inevitable... just a question of time... and luck...

Nothing much to cheer here...

Yes, Solar.. Such is the callousness of our police force (!)...
I am sure they (the police) must have whisked away a few alcohol bottles that could have been smuggled by the Innova driver from Puthucheri to Tamil Nadu and as a courteus gesture, they are 'sympathizing on the driver'...!!!

the statement from police is -- the driver was so drunk he didn't realize what happened... and now that he is sober is worried what will happen to him! -- what ridiculousness!

Hang him! any other punishment is a burden on his family
1. revoke driving license - bribe and get aother. maybe under different name.
2. Not allow him to drive - who will monitor?
3. Send him to jail - waste of tax payers money!

And this will send a very good message out to the drunk drivers out there!

One common excuse I always hear is - esp from lorry drivers - we travel so much and are away from home for so long - so we drink! They chose that profession!!!
