Nike_123 said: right KBsir...currently such cases fall u/S. 304A IPC..if i'm not mistaken which is causing death by gross negligence or recklessness and the max penalty handed out in such offences is upto one yr RI which is clearly not sufficient. wht the law commission can do in this matter is insert a sub section which would only deal with death caused by negligent driving...normally this section is applied widely when docs are involved in cases of medical negligence which becomes a different kind of offence altogether. Docs always perform their duty in good faith however rash driving is a blatant disregard of public safety which should in my opinion be dealt with very strictly. June 21, '08 |
